Let me clarify... what I meant to say was if someone used a gun to stop someone from robbing my house and the suspect happened to die, I wouldn't feel bad. If the intent was to slow them down, I'm okay with that. If the intent was to kill them, I'm not okay with that.

Wow...he needs to thank his lucky stars that he lives in TX. If he were here, he'd be looking at 2 counts of murder, possibly premeditated. He'd have a hard time convincing a judge here that the burglary of his neighbor's house justified his use of deadly force. Generally, deadly force can' t be used to defend property.

Pretty much - I think it's been rehashed a couple times... I seem to remember one incident where the robber was approaching the homeowner, who happened to be a cop, and was shot and died. And the cop was put in jail for use of trained deadly force.

You don't shoot with 'intent to injure', you shoot with intent to kill. If you ever think you are pointing a gun at someone to 'scare' them or 'slow them down' you risk getting killed yourself. If you pull the trigger, aim somewhere thats going to stop whatever it is for good.

Move to Florida. Their self-defense laws are pretty top notch. Pretty much the "fear for your life? shoot them." Florida is one of the few states that made it easier for you to defend yourself in the last decade.

*edit* although remember Taylor didn't have a gun because he wasn't legally allowed to have one since his waving of a firearm in regards to ATVs.

I've never been in that situation so I can't say for certain either way but I'd like to think I'd shoot with the intent of stopping them not killing them. Maybe it's semantics but I wouldn't purposely set out to make sure they were dead and I certainly wouldn't say "bang, you're dead!" before I pulled the trigger.

I am well aware of the "castle doctrine". That's why I said he should be thankful for living in TX (because of that law), and said "generally". There are exceptions by statute to common law rules, as there obviously is in the case of Texas. And yes there are exceptions for someone in their own house, time of day, etc.

(although I will add that Texas has taken the Castle Doctrine and made it into more of a Kingdom Doctrine.)

Anne and I were talking about this just the other day.

If someone breaks into my house, i dont give a shit if they take my TV or my computer. Im putting my family in the bedroom and if they come near it they are dead.

The only thing dumber than putting your life at risk over some stupid crap in your house that a theif wants to take is putting your life at risk over someone elses stupid crap that theives wants to take
