Always loved that sterling grey color. However, if I was going 2003 e39, and not an M5, I'd go with the 540i sport with M package.

When I get one I want it to be my DD so i figured 530 would be better on gas than the 540, with still fairly nice power. I'm a sucker for that grey as well.

The 540 isn't really that bad on gas. I've driven Lauren's (automatic) 540 and had it read 26ish highway. Of course, around town it won't be great. The thing with the 5ers is that they're just big enough that an I6 has to work hard to move it, whereas a V8 can loaf along at 2k, so the MPGs kinda even out.

No no, the 540i really is that bad on gas. Real life MPG is like 13-14 in town and 19-20 on the highway unless you're coasting down a hill, drafting a semi, with a tailwind, in which case that higher reading is only going to last until halfway up the next hill.
Honestly 140k for a 530i isn't that bad, provided its been maintained well. My biggest concern would be the suspension components and cooling system. If it has fresh bushings underneath it's good to go, that's probably the shittiest thing to have to do on a 5 series.
We're about to hit 140k in the 540i and we need to do the valley pan and intake manifold gasket job (doesn't apply to the M54B30) and front control arms, which I'm not looking forward to in the slightest. Everything else has been pretty solid in the 30k miles we've put on it, but our previous owner was pretty awesome about fixing thing as soon as they act up.

I dunno, is the 530 (I assume you mean a 3.0I6 530 and not the old nikasil 3.0V8 530...) that much more powerful than a 528? Cuz Dave Allen's 528 was kind of a dog.

They are very meh. 216ft-lbs i think and 225hp. They'll move around town without needing to be flogged but that's about it. The 525i's are the completely abysmal ones.

I like 530's! That would be enough for me to be content on a daily basis. Granted... I haven't driven a 540, yet. I also feel like the 528 is redundant, sort of like the four door 6 series.

They might have the secondary pump/valve that the E34s have, I'm not sure. Jake ought to know.
If it really has been gone through mechanically, it should have a pump with a metal impeller in it now, which should last a pretty long time. When I did the last refresh on the E36 I didn't even bother changing it or the thermostat.

528i was the predecessor to the 530i, it used the same motor as the E36 and early E46 328i's.
And yeah, a 530i will move itself around just fine, its just not going to win any races or smush you into the driver's seat when you hit the go pedal. A 330i is a much better option if you don't need to loaf business colleagues around in cushy comfort. A 330i has a decent amount of pull despite the stupidly long differential they stuck in them, and is waaaaaaay more fun in the corners than a big clumsy 5er.
I love the 540i, it gives the car an engine to back up its size. Gobs and gobs of torque off the line so it can butter around town effortlessly, and a powerband that's still fun to run out every once in a while. I've really enjoyed having ours. That being said, its an expensive car to own, and I don't know if I'd want one for myself as my only car. Honestly, if we were to go back and do it all again I'd probably steer Lauren away from it and try to get her in a nice 330i. Much better on gas, lower maintenance costs, easier to work on, and would still give her pretty much everything she likes about the E39 with the exception of face-melting torque.
