Lemon Law

JPolen01 Wrote:Well MD seems to have some pretty friendly consumer laws. We found a lemon lawyer that actually one a case just like ours for a defective GPS unit. Fees are deferred to manufacturers in this great state so win or lose we pay nothing. This firm reviewed our case and wants to take it on. Will probably go with them as they will do all of the work for us.

Their goal is to have Mazda fix the car and then pay us the diminished value for the problems. I am still putting together what that means but they are saying that Mazda should pay us for the time the car was in the shop, the multiple trips driven back and forth to the shop, as well as the drop in value during this time. In turn we could then sell the car (if we decided to) and not lose much money. At the very least we get a fixed car and some money back (if we win). Cool with me!

Waitaminute. Does, "fees" include your lawyer's fees? Meaning that win or lose, they get paid?

I don't know if they get paid if they lose. All I know is we don't pay ever. From our conversation today with them, they expressed that is extremely rare for the manufacturer not to settle as they would rather not pay their own attorneys to fight it out in court.

Not to be a contrarian... even though I'm so good at it... but it sounds too good to be true.

Goes without saying, but make sure you read all fine print before signing any sort of retainer.

"Here, at last, is the cure for texting while driving. The millions of deaths which occur every year due to the iPhone’s ability to stream the Kim K/Ray-J video in 4G could all be avoided, every last one of them, if the government issued everyone a Seventies 911 and made sure they always left the house five minutes later than they’d wanted to. It would help if it could be made to rain as well. Full attention on the road. Guaranteed." -Jack Baruth

Uhh, i'd look up on that if I were you. Just from some quick Googling you are very much on the hook if this goes past arbitration and to court and then lose. Hopefully it doesn't of course, but it's certainly not a, "we don't pay ever" situation for sure.

Yeah I should have clarified. What Ken said is correct. From the research I have done it seems like an extremely low percentage of these claims even make it to court. I will review the documents once receive them via mail in a couple days.

Received the package from the attorney today. In bold letters on the first page "There is absolutely no cost to you for our legal representation. In consideration you agree to participate as the case progresses."

Later in the document:
How can (insert firm) provide free legal services?
"(Firm) has prided itself in offering legal representation with no cost or fees to the plaintiff. When we win, we seek our fees either by agreement with the manufacturer or through the Court, under State Lemon Law and/or State and Federal Breach of Warranty Laws. These fees are separate from any settlement or award got receive. If we lose we receive nothing. For this reason we must be very selective when we accept cases."

They said the process can take anywhere from 2 weeks to 6 months depending on the manufacturer. Ultimately we are hoping for a settlement instead of going to court which seems to be how the majority of these cases are handled once a lawyer is involved.

Update time. Yay!

Got a low ball offer from Mazda that the lawyer laughed off. Countered high to hopefully meet in the middle and they came back pretty much where we need to be. With the offer we can sell the car and almost break even which is a win for us. Pretty much getting back what we have paid plus depreciation. Should receive the check within 30-45 days.

Moral of the story - don't listen to the clowns on this board. Fight for what you believe in and make it happen!

That's cool though, glad you'll be out of the car with only an aching head and not the wallet also.

What's next? I'm sure it's not classy enough but I really like the Hyundai SUVs. They look pretty nice appearance wise at least.

We looked at the hyundai duo when shopping for the mazda. You get a lot of bells and whistles with them for a fair price. The styling makes it look like an elderly person's car though. Not really sure what to look at. Wife wants to look at 4 runners which I'm not opposed to. I know Rex hates them but I'm not buying a Flex so....

Really? I think the Hyundai's look pretty sleek. Especially the sport models but Idk how they fit in budget wise with the 5. I think the 5 is way more old person looking than pretty much anything else on the market.

Which 4 runner? New or like Cabell's year? The new ones are kind weird looking

We have to be realistic here.

New gen 4 runner. Used examples are stupid money. It doesn't even make sense unless we were looking for one much older. I would love a TRD edition but they are pretty expensive.

Forester? Or is that too "old" for you two?

Does the 4 runner even fit the bill? I don't remember the original criteria other then led headlights and Honda. (but the Porsche dealer who had it sucked)

But for real the 4 runner is like twice the size of the Mazda. Does she really want to deal with that?

Also because I'm sure it'll make Taylor cry. I think the TRD one is the ugliest. Especially in that orange.

Nice job! The New CRV (2017) is going to have a turbo option and is supposed to be really nicely appointed. Maybe you guys could peep that:
