No, he wont pass. Even if his NOx is low enough w/o the EGR, he wont pass because they check to see that its there.

Firts, I'd figure out whats wrong with the EGR valve. A fairly common problem on the SR20's is the EGR tube that goes from teh manifold to the EGR valve gets clogged. Its only the size of a pinhole, perhaps yours is the same. If the valve is actually broken, and its cheap, then i'd replace it. No need to pollute. Another thing, my car uses a BPT (back pressure transducer valve) to activate the EGR valve. You should look into the details on how your EGR system functions.
