Id certainly question the officer's situational awareness if he couldnt see the guy, but the gimp was at fault.

he was in the crosswalk and last time i checked, pedestrians in a crosswalk have the right of way. it just makes it worse because its a cop who hit the guy who should probably be a bit more aware and because they gave him a ticket afterwards

I won't be arguing about the gimp... but I have a serious problem with this mentality/law. People interpret this to mean they have "right of way" (which is a misnomer in the American driving system) and can just do what they want. Just because you're a pedestrian doesn't mean that you can hop right into a crosswalk and expect traffic to stop - that's absolutely unreasonable and shouldn't be protected. You're crossing a _road_, a place where cars travel, and you need to make a reasonable effort to pick a time to cross where you won't endanger yourself or cause cars to have accidents trying to avoid hitting you. Who knows what what happened with the gimp - I just wanted to rant.

andrew, i agree 10000000% and i think pedestrians around UVA are the worst. however, i dont think that argument will hold up in traffic court when you hit the pedestrian and in civil court when they sue your ass because you broke their face with your car.
