I'm honestly curious. How does Ferrari meet CAFE standards? Or are they exempt? Is there a loophole for small Italian companies that make cars for the rich?

Since 1983, manufacturers have paid more than $590 million in CAFE civil penalties. Most European manufacturers regularly pay CAFE civil penalties ranging from less than $1 million to more than $20 million annually. Asian and most of the big domestic manufacturers have never paid a civil penalty.

Pass it on to the consumers, like every other regulatory penalty.

To be fair, not every, and all portion, of regulatory penalties are necessarily paid by the consumer. Although there are other factors, tax incidence depends heavily on the elasticity of the good in question.

Agreed, however consumption for a vast majority of goods that incur regulatory taxes aren't highly elastic.

Gas, sports cars, tobacco, alcohol and utilities come to mind.

Are CAFE penalties the ones that go to NHTSA? Whatever that penalty is, I believe BMW holds the title for most CAFE penalties paid by manufacturer in one year, but it might be Benz. If not, BMW is 2nd to benz.
