MM,
I'm interested in some suggestions and opinions regarding Insurance for the track. I'm not necessailry looking for collision insurance for the track, unless there really is a company that does this.. I'm more interested in liability insurance so that someone doesn't come back and say "you made me spin, crash, and now I'm paralyzed, that'll be 2.5million please."
I know we all sign wavers and whatnot, but this is a lawsuit happy society. Is there some sort of protection here? And don't say "don't punt people."
Thanks!

there really hasnt been any precedent set in this matter. Even when a driver has died from someone elses screwup I have never heard of any legal suit filed.
Of course that doesnt mean it can't happen, especially among the HPDE crowd who often dont understand the risks envolved.
But I havent heard of any underwriters offering liability insurance for on-track.
ps- dont punt anyone
punt 'em, just make sure you finish 'em off.
I have no clue man. Certianly something to think about though eh?
I looked into this with my insurance (state farm) mainly to see if they would cover damage to my car or myself... basically they didn't like the words "race track" even though I described in detail that it was a driving school with an instructor... blah blah blah
the NASA website says there is a way for it to be covered, but I can't figure it out.

yeah I did, he basically said to check the fine print and ask your insurance, there is supposed to be a way for it to be covered.

cobetto carries liability and bodily harm insurance at every event. Any personal insurance should be used first because of course he doesnt want you to use it even if an incident does occur.
Im not really sure how this would apply to one driver suing another driver.
ps- scratch what I said before, I do vaugely remember a story within the last couple of years (pure hearsay) where a P-car driver wrecked and died, and his family sued the track and got loads of money, despite the multiple waivers and full risk responsibility on the part of the driver. (I hate lawyers. Except for Jess. She rocks.)
What if a driver is pissed at another driver and decides to send him spinning into a guard rail or what have you? Can the 'victim' go personally after the 'assailant'? Or is that the risk you take when you take your car on track? The 'assailant' could say it was just competitive racing or what have you...

Not all of them are bad...and don't forgot they're being hired to do a job...and lawyers don't "sue" anyone (it's never "Your Lawyer v. Defendant"), they're just the representative.

Deliberate contact falls under vehicular assault and if death results would be vehicular homicide if someone decided to press charges.
Jess, post edited

You are right 99% of all lawyers make the rest look bad.

Evan: That's better
Chad: Being IN the profession, I would have to disagree... the 1% EVERYONE hears about through the media makes all the rest look bad. And there's the old line about everyone saying that until they need a lawyer...then they want the most ruthless one they can find!
And I'm done. Back to drafting a complaint...

Jess,
What is your opinion on this issue? Is it even an issue? If so, what are your suggestions?
And this isnt' just for me, any of us that partake in these events needs to at least know one way or the other as to wether or not we should be concerned, and what actions to take if so...
Thanks!
