I havent been back in Fairfax county more than 2 days... and i get two tickets... i was on Bradock Rd... turning right onto 123 headed to hoodbridge sunday morning. as soon as i turn on the road there is a police officer with a neon pulled over... i move from the right lane to the left because he was outside of his car walking back to it. i look down... i'm doing 40mph in a 45mph zone... i think "sweet i actually wasnt speeding..." 3/10 of a mile later i'm stopped on the side of the road... and his first words are...
"why are you driving like a maniac? are you trying to kill someone?"
me: *stupid look*
"give me your license and registration"
me: *hands it to him*
police officer: *walks back and writes up the tickets... then comes back 15 minutes later*
police officer: "you do know your exhaust is illegal... and i'm writting you a ticket for failure to obey a highway sign"
me: "sir what highway sign?"
officer: "the speed limit"
me: "did you catch me on radar?"
officer: "no"
me: " did you get me on laser or pace me?"
officer: "no... but i had to do 60mph to catch you! thats uncalled for in this area... the speed limit is 45!"
me: *starts to speak*
officer: "you save that for the judge i dont want to hear anything you have to say... you are free to go"

now it was a GMU officer.... so i'm sure when i go to court i'm going to have to have BIG charts with math... but just because he was doing 60mph to catch me in 3/10 of a mile... from a dead stop... doesnt prove i was speeding. if anything... mathmatically it proves i was under the speed limit.

a police officer cant go the speed limit to catch someone doing the speed limit i wonder if they give the police officers free classes to take at GMU... i have a couple of recommendations.

yes i'm going to court again... i cant stand being charged for something i absolutely didnt do.

that's ridiculous man, i'm sorry to hear about it Sad

i really hope that the courts find you innocent, i'd even consider a lawyer to be taken seriously - since they usually side with the police officer and then not allow for an appeal.

lol you can file an appeal for anything after the judge condems you to death... they now give you 15days to actually pay any fines ... so that is the time frame you have to file an appeal too.

and i'm not paying $500 for a lawyer because this idiot cop "thinks" i was speeding.

I want to come to the courtroom with some popcorn to watch, just so I can see Kaan pull out the charts and graphs (and bullhorn?) and see the look on Officer Douchebag's face when the Judge looks at him like a complete moron

speeding tickets are fun... pretty much impossible to win, but you may be in luck. i got one a few weeks back AS I WAS PULLING OUT OF A PARKING LOT. apparently an s2000 can reach 44mph in just about a second when it is on E and has a fuel starvation issue (i can't give the car any gas at all on a low tank)... highest i saw my speed was 34, but it isn't worth fighting.

i've been to traffic court more times than i care to admit to. but for the first time in my life... i know for a fact i wasnt speeding... at all... and i REFUSE to be charged/convicted for something i didnt do... btw... they dont allow food, drink, or cell phones in court... no cameras... so we arent going to get any pics of me in action Wink

good luck to you sir, the last time I tried to used "math" a few years ago, they found me guilty for failure to yeild when I got squarly and very lightly rear ended. I hope you don't get a judge like I got. :?

The facts I presented to him:

I made a u-turn, legally, at an intersection with a light, accelerating hard and had just shifted to 2nd, so I was going ~30MPH.

Woman who rear ended me, from the lack of much damage was probably going 5-10MPH faster than me at impact. So 35-40MPH.

It's a 45MPH zone and there's a huge black skidmark from her braking down from god knows what speed. And the skidmark even changes lanes into mine.

Speeding forfeits right of way (I looked it up). A tap of the brakes would slow you from 45MPH to 35MPH. She HAD to be doing over 45MPH sir.

Him: (with the I made up my mind before you came in here look) Doesn't sound like you have much of a case there.

Me: Well I'm not a lawyer, I'm just trying to show that there is at least a lot of doubt that I was in the wrong here. And I being the only witness here, since she didn't even have to show up, and the cop didn't see the accident happen, am just trying to convey to you what happened.

Him: (in so many words) Guilty, GTFO

Channing... this is really all i have to say... without much math.

1. ask the cop where he was when he saw me
2. refer to the ticket for the spot i was pulled over
3. note is was 3/10s of a mile difference
4. ask the cop if he was moving or stopped.
5. ask the officer how fast he had to go to catch me... knowing his whole premuse for pulling my over and giving me the ticket for the highway sign was he had to do 60mph to catch me....
6. ask the judge if it unreasonable for an officer to have to do 60mph in a 45 zone, while i travel 45 mph ... to catch up to me and have me stop, in nearly 1/4 mile. I dont think so... i think it would be damn near impossible to catch someone going 45mph from a dead stop as fast as he did without breaking 60mph.
6. if the judge gets all wishy washy... i break out the charts.

btw a crown vic will do 1/4 mile in 17.8 seconds @ 80mph... at 45mph (constant) i travel 1/4 mile in 20 seconds... meaning if i were actually doing the speed limit (because i was going slower than the speed limit) i think he would have noted 80mph and not 60mph Wink

there are SO many ways to counter anything the officer has to say. the only thing i cant counter right away is if he LIES and says he was moving on bradock road... but then i just have to continue, supena the GMU radio traffic records... they have to call in when they stop someone and when they are active again... and compair them to the time on my ticket... and go back to court.

i refuse to let the man stick it to me because i drive a loud honda... yes i'll pay the exhaust ticket and i'll actually get it fixed... but you are NOT going to get me for a moving violation when i was driving slower than most senior citizens.

it was the same cop... when i turned right i definately looked hit right in the eyes... moved over to the left for his safety... and he rushed to pull me over. and again if he denies all that... and says he was moving when i passed him... you pull his radio log... his in car camera... police officers keep dates, times, and places at almost all times. Smile

i am going to have to file a complaint if they drop the charges... because i drive that direction every day to and from work from the new house... and if he wants to pick on me... i have to have things documented.

since it isn't speeding, they might. speeding they just say "laser is infallible, our guy definitely was aimed at you, pay us."

the line on the ticket says... "Failure to Obey Highway sign (speed)"

thats a speeding ticket... the sign he said and noted i didnt obey was a speed sign.... now he has to prove it.

all the more reason to fight. if i won the lotto... i'd pay an attorney to play the game with the traffic court system... so its actually court... and you arent treated like you are guilty as soon as you walk it. it would cost millions... and to be honest attorneys wouldnt want it... the states wouldnt want it... it be a mess... longer court times, etc.

Any judge without his head up his ass will throw the case out as soon as he hears that the cop didnt get you on radar. Of course any flunkie lawyer who took a job as a traffic court judge almost definately has his head up his ass
