anyone have any recomendation of what paul should do to get fair value for his car. Im sure insurance will only want to give him like 1500 bucks or so. Fair market value for the car would have been 7k ish. Im trying to give him advise so he doesnt totally get fucked here. any thoughts?

good luck with that, insurance companies usually only cover "stock" parts unless you specify it (i have an agreed upon value on my Miata with my insurance company). I would try to find other cars at about the same "spec' has is and see what they are selling for. Other than that, he might have to take the driver and insurance company to court to try to recoup his money back

without having claimed parts beforehand, his best bet is buying the car back. insurance isn't going to pay for parts you weren't paying to have covered...

Paul and I are also open to advice as far as settling up with the insurance company for pain and suffering and such. Obviously they will be paying medical bills but they will want to settle up beyond that. I know I shouldn't sign anything and I've also been told to hold out. Insurance companies have to close so many cases a month and can only leave cases open for a certain amount of time so the longer I hold out the more they are going to want to close, but any other advice?

uhhh they will hold out for quite a bit of time. my mom's two accidents were not paid out for 2-3 years after the fact.

Number one, I am happy to hear that you guys made it out as well as you did. Sounds like it could have been so much worse...
I'm upset to see another truly fine dub leave like that. I'm not a huge fan of them, but Paul's was an exception and I was thoroughly impressed the few times that I got to see it. That is truly unfortunate.

The only thing I can tell you is that this going to take a while. I was hit on July 21 and mine has still not been settled. I assume that you all went to the hospital and therefore will have bills. Hospitals seem to take several months to get their bills to you, and therefore it will take quite some time to be able to settle on that. In the meantime, if you have ANY kind of hurts, no matter how minor, have it checked out.
Settling on the car will probably occur much more quickly. The value of my truck was based on local prices for similar vehicles, not NADA (I have no idea how they got the number, but it was definitely in my favor), less damages prior to accident, then settled. I'm sure Paul doesn't want to be thinking about this right now, but he'll have to decide in a week or two what he wants to do. Considering all the work he had into his car, it might be worth it to buy it back and part it out or put it onto another car. The other option would be if they will account for what the car would sell for, so I'm interested to see how that goes.
I'll share more later. Basically, don't sign anything, but don't expect it to be over real quick either.

RE the part in bold. I would have told them to take that number and shove it up their lilly white asses. Who gives a CRAP if there was 'prior damages' in court it doesn't matter. If you have a bumper on your car with a few scratches on it sure, it's not 'new' and nobody would pay like new prices for it. So if someone then rams into you cracking the same bumper in 1/2 they don't buy you a new bumper 'less prior damages'. That's BS. They pay for the ENTIRE cost of a NEW bumper. You could have gone the rest of your life living with those scratches but you won't go riding along with a bumper that's cracked in 1/2! I hope you didn't settle with them on a price for your truck minus prior damages. If so you just got a screwing. I would have told them see you in court, at that point they would have raised the price b/c they KNOW they'd lose in court.

thayer, glad to hear that you guys are alright for the most part. that really sucks that paul's vw is totalled though. what was that dude charged with? i assume the arresting officer has all that guy's insurance info and whatnot? i would probably be on the phone with that officer or that dude's insurance company like everyday until they give you whats fair for the car and then hound them again when you get the hospital bills.

Actually the adjuster I ended up working with was really cool, he knew it was a bullshit move. Based on their calculator, which took average price for sale, less damage to entire car prior to wreck, I would have owed them a couple hundred $$ :-D. He threw out their estimate, deducted a little and comped me for a rental :-). He was a fellow racer actually, and totally understood how much it screwed me to lose a reliable tow vehicle, regardless of what it looked like.
Yeah, I probably could have pushed for more, but to what end and how much? We all know the truck wasn't worth a lot, despite how well it ran and how sturdy it was. We'll make up for it on medical compensation.

What's up everyone...just wanted to let you all know I'm up on here now. Guess you all read about the accident Thayer and I were in on Friday. It really sucks but thankfully we are ok. My poor GTi is dead, that car really meant alot to me. I guess I'll be having the run around with the insurance company for a while. I might consider talking to a lawyer maybe to get some advice. I actually went to the hospital today to get looked over, and turns out I don't have any structural damage, just muscular soreness. I'll keep you all posted if anything new happens.

Wow you guys are really lucky, getting rear-ended like that by a car that weighs about twice as much as yours and is significantly stiffer really could have been a lot worse. Like Chan said, if you have any pains at all go to the hospital and start any rehab or therapy you need to as fast as possible. You don't wanna be hobbled with residual effects.

Man, I think MM is on a good luck streak, everyone needs to buy lottery tickets. Last week by front brake lever on the motorcycle fell off while I was on the highway Confusedhock:. I didn't notice until I was on the off ramp. Luckily I was not in a situation where I had to brake hard otherwise I could've gotten fucked up.
