Fantasy land... fairfax county... close enough.

So if a cop pulled you over on your bike, what are you going to do? Refuse to give him your registration and license becuase its absurd, illegal, unconstitutional, or just plain egregious?

No, I'd comply, but if he said thats the only reason he pulled me over, I'd be filing a complaint.

And Driving is a Right as ruled by the courts.

Nobody has addressed the "need a reason" point yet. I scanned a few LEO boards and they seem to indicate that a cop can't pull you over for no reason at all, and the points I posted made a reasonable connection. It seems pretty evident that the Police need a reason to pull somebody over. Sure, it's easy for an officer to find a reason, but that's better than nothing. A privilege does not automatically mean that the concerns in question are automatically void, or worthless.

What if the reason is "we just got a report of a stolen (insert whatever crotchrocket you are riding) in the area and we want to check your registration?"

Is that acceptable enough to make you guys feel warm and fuzzy inside about being pulled over?

Most Cops i've been pulled over by have been pretty cool. They're people too, they're doing a job and they want to go home at the end of the day just like everyone else. Sure, sometimes you get a ticket, sometimes you dont, but thats just the way it goes. You're not going to get the interrogation and intimidation bit unless they clock you at 90mph going up route 28.

speaking of which, did it bother you when I said "We got jewed" the other day? I realized later on that may have been inappropriate, but I'm not aware of any of our mutual friends being appropriate... ever.

That's not even remotely true. But I'm not arguing that point right now.

And to respond to RJ, no, it wouldn't give me the warm fuzzies. If my car might be stolen then run my plates without pulling me over - they can do that, y'know, you aren't the only one that knows how to use the internet. But that still misses the point.

Do you think because you think that something is small and menial that a P&P laid out for it doesn't need to be followed? I went out with the half pint last night and on the way back I drove because she'd had some drinks... ok, no big deal, right? But if she gets pulled over and happens to get a DUI that's the end of her profession because of laws imposed by the sanctioning body for whatever it she wants to do. It's one DUI ticket, which admittedly isn't that small, but isn't that large, either. There's a hundred and fifty two ways for somebody to be improperly convicted of drunk driving and the consequences, as evidenced by my date, could be disastrous even in something trivial. Just because something doesn't represent a concern to you doesn't mean that it won't to somebody else.

There are laws in place that govern how laws are enforced and I believe that they need to be followed with the same rigidity of the intent of the original principle.. moreso, even. They're all in place for a reason. Whether a cop is a good person or not is irrelevant - I get yelled at when I fuck up at work, so do you, and even good people can screw up. Just because somebody's a good guy with a family, though, doesn't mean that I should just bend over because I'm riding a sportbike.

actually rights aren't limited to what are explicitly granted by the Constitution or Amendments. That's even stated in Constitution.

Ok, but you know this going in, and its no secret.

If you choose a profession (for example, we'll use Intel Security) and you get busted for a DUI you'll probably lose your job. But you knew that going in and you make the choice to pursue that career. No one forces you do it, and if you dont like the constriants that it places on your life, then quit. If you are an elementary school teacher, you should quit your part time job hosting kiddie porn. Its common sense.

And if it does happen, suggesting that you are somehow the wrongfully convicted victim in some sort of totalitarian police state is completely absurd. But nice try.

They can run the plates and check if the registered owner of the bike has a M Class.

Are you going to avoid the point on everything I say?

The point in the example about Rosa was that there are a lot of ways for an officer to screw up a sobriety test, and a lot of policies they just don't follow. Before you blow into a breathalyzer the officer is supposed to observe you for 20 minutes to make sure you don't burp - did you know that? Otherwise the test isn't accurate. The test isn't actually accurate, anyways, for a number of reasons, but that's not the point. The point is that there are a lot of things that can get screwed up when you start down the "well, if you've got nothing to hide" path. Justice isn't infallible, that's why it's a living, growing system. The "just do the right thing and you'll be ok" circle jerk shows a lot of naievity and complaceny.

What if I'm out riding home one night and an officer does a random registration check. Lets say I've been working on the bike that day and I had one beer at the bar. Well, Mr. Officer pulls me over for no good reason and says "hey, you smell like beer, take off your helmet and blow into this thing". Well, I was working on the bike's fuel system. The way the breathalyzer works it is influenced by fumes you inhale when working with fuel (and a long list of other things causing it to read falsely high) - UH-OH! I blew a pretty high reading.. but I only had one beer. And I wasn't exhibiting symptoms of impairment - I was just riding my sportbike home.

So I get thrown in jail for a DUI. I lose my job. My insurance. My license. A lot of my potential just went down the fucking tube because of a stupid series of bad luck coincidences. And that's not even reaching! That's something that could happen to any of us. After the 12 hour Rob would have blown a hugely high number into the breathalyzer, so would I, from all the fuel we spilled on ourselves. That one alone could have been avoided with probable cause.

I could make up scenarios all day long, and you could fire back and tell me why that's not likely, or stupid, and say I'm way too much of a conspiracy theorist and to take off my tin foil hat. But would you disagree that there are certain policies in place for your own protection when dealing with authorities? That's what I'm driving at.
