Didn't we actually run into a similar situation on 340 last week? A tractor trailer was merging onto the highway and rather than give it time to come over and whore us we all speed up and got out of the way.
I would think if you're right next to the thing and he's in a position where he can come over on you you've already failed to ride aware.
