It's not a 4th Amendment (search and seizure) constitutional violation that they're claiming but instead a separation of powers issue found under the Articles of the Constitution (which one I forget)....i.e. whether a division of the executive branch can constitutionally "raid" a member of the legislative branch. The constitutional argument is that they cannot.
