In America the city/state would pay dearly for that. Almost like McDonalds did with the hot coffee BS in the 90's... "Caution: contents may be extremely hot" You need to post signs for the stupid people in this country.

The issue with the coffee was not simply a matter of a posted warning. McDonalds used a lower grade coffee bean that required a brewing temperature that was deemed beyond the expectation of temperature for that of a reasonable person. Compounding the issue was when the customer asked McDonalds to ONLY pay the medical bills incurred as she suffered 3rd degree burns within 5 seconds of the spill, McDonalds refused.

At that point, McDonaldÔÇÖs gross negligence removed then from normal compensatory damage liability to punitive damage liability. The difference being that the monetary judgment in a compensatory case is limited to offset the negative effect of the tort, whereas, the judgment in a punitive case is based on the size of the organization at fault. The punitive judgment serves to punish the organization at fault.

Know your facts before you use an example that really has no correlation to the example at hand. I feel sorry for someone who is hurt by the intentional actions of a firm to marginally increase profits by dangerous means.

I donÔÇÖt feel sorry for some idiot who is grossly exceeding the posted speed limit, and by that action experiences property damage.
