I'm getting 6 pts just for comfort reasons, but I think it is absurd that this guy was trying to convince you that you'd be reprimanded at an event for having a 5 pt in the passenger side.
1) At this point, you having a passenger is optional. You're an instructor and you'd be providing your rider with plenty of safety. Hell, there's a lot of instructors that don't even have a passenger seat.
2) The safety difference between a 5 pt and 6 pt is marginal, in my opinion, and the biggest difference would be the comfort levels during a sudden stop.
Take it back and get the 6 pt for you. Don't listen to him bickering and tell him if he doesn't like it, you'll take your business elsewhere.
