Insurance Dispute Advice

Hey guys- wanted to see if anyone had a similar experience or advice--

Last week while heading home for the weekend I had the misfortune to be about a hundred yards behind an eighteen wheeler who decided he didnt need his two left rear tires-- hit almost a full tire which cracked the bumper in a couple places and pulled off my fog light cover, side strake and front lip-- Stopped, exchanged info with the driver who was extremely apologetic etc etc.

Now dealing with his insurance agency has been a different story. Talked with an agent the following morning- asked me to send over pictures an estimate. Sent that a week ago from today. Had trouble last week getting in touch with that agent, but finally found out a claim had been "opened" for my case- sounded like progress. Yet on Thursday, my parents said they received a letter at home from the insurance agency stating that they could not be held liable for the damages, basically eff off.

Has anyone had experience with something like this? Is this just a policy they use on every case- deny damages up front? Is it time to have a lawyer draft up a letter in response?

What's the company, what's your coverage and what was their reason for denial?

Probably what you may need to end up doing is calling your own insurance company, who will likely handle the damages and then sue the other guy's company for compensation if they think it's something they might be able to prove fault on. I have a feeling that his company may not be liable though.

no advice, but I'll be interested to know how it turns out. I've always hated that trucks seem to be allowed to litter the highway with objects that will break cars and kill motorcycles. And I always figured the trucker probably never knows/cares. Would be nice to know if you manage told hold at least one liable.

Ohhh, I just read that it was his insurance agency. reading > me

Yeah, screw dealing with them. Make the claim on your insurance and let them fight with his insurance. It's what you pay them for.

Well one thing to think about, if you hit a bag of trash that falls out of a car and its in the air, its not your fault and its the other person insurance that needs to pay, but if you hit that same bag of trash after it hits the ground, its a collision and you would be at fault. That is the way I understood when it was described to me. (By definitions of the word collision)

Ouch that sucks, sorry to hear. I'd definitely let the pros at your insurance company deal with it. Those companies can be a huge pain. Good luck.
