Declaring independence of british colonial rule has exactly what to do with giving foreign terrorists protection under the constitution?
at least quote the Constitution Rex if you really want to try to make that point

no, you lose them (or moroeover, the protection of them by the US Constitution) by not being an american citizen.
homegrown USA terrorists still get every constitutional protection just like they should.

I agree with you evan, but since he quoted it as saying that a person (to include non-citizens) has those rights, I was trying to make a distinction of where a right ends and begins. A non-citizen terrorist has no U.S. rights as far as I am concerned, other than to possibly remain alive during custody, and attend a war-time trial.

I dunno Ev-dawg. The constitution does not grant us what rights we possess. It recognizes "certain inalienable rights endowed to us by our creator" that our federal government may not infringe upon. Says as much in the preamble, which is why I thought it was appropriate.

Like it or not, the declaration of independence, despite being ostensibly as you say about "declaring independence from british colonial rule" has set the tone for quite a bit of policy, and not unjustly so. They were saying that all men, british citizens or not, regardless of what The Crown had to say about it, were endowed with certain unalienable rights. Pretty strong language to lay the foundation for a new nation, and certainly not to be discarded so flippantly when discussing civil rights.

If we're talking about Guantanamo detainees, there's a fair amount of innocent guys who were snatched up because the northern alliance members wanted bounties e.g. the Uyghurs. You can't snatch people up without evidence of guilt and detain them indefinitely. North Korea is doing that with the two American journalists and we're pissed as hell about it.

I assume that if the government wants to label folks terrorists, there must be evidence that will stand up to scrutiny. I'm sure Evan and Derek will agree with me that the government always does a good job of managing affairs and that the bureaucrats that have shaped this detainment policy put the good of the nation ahead of any short term political gain/expediency.
