The "Failure to Obey Highway Sign" is what they give if they don't get you on radar or some other measuring method. It's a catchall because they don't have to say how fast you were actually going, only that they <b>observed</b> you going faster than the speed limit.

Bottom line is it's your word against his. If you lose, appeal.

the naked eye... no matter how well trained cant determine the exact speed... he didnt see me going fast... his only cause to write the ticket was that he had to go 60mph to catch me. when i walk in there, charts and all, that judge is going to end up never beleiveing any "obersvation" that cop has for the rest of his career. Smile i'm going to sink that pigs battle ship.

Channing, when did you look this up because a few years back when I was in an accident the judge flat out told me that excessive speed doesn't forfeit the right of way. I was told that the annoying teennage girl who hit me could have been driving a rocket ship and I still have to yield the right of way to her.

§ 46.2-823. Unlawful speed forfeits right-of-way.

The driver of any vehicle traveling at an unlawful speed shall forfeit any right-of-way which he might otherwise have under this article.

I got nailed for a failure to obey a highway sign (speed limit). Here's how this particular cop (and a couple of lawyers on the phone told me) was able to pin it on me. Since I didn't see her and passed her (lmao) but she didn't gun me, she would have been travelling the speed limit. So since it's my word against hers that she was travelling the speed limit (obvious loss), I was speeding since I passed her. In your case, since he was stationary, you might have a chance.

Of course he had to fucking speed to catch up to you. If you were going the speed limit and he was going the speed limit to catch you, physics would say that he would never catch up to you........

I doubt he went to college =p

Technically speaking, he should never catch you anyway. If you pass a cop, and he's sitting still - and he takes off after you, you have already gone X amount of distance. By the time he gets to the end of X, you have gone another Y amount of distance...and so on and so on. The hare can never catch the tortoise.
